Data Protection Declaration

1. Preamble

This Data Protection Declaration applies to the processing of personal data by Ritter Schierscher Rechtsanwälte AG in the context of client representation as well as the website (www.ritterschierscher.li). We process personal data in accordance with the EU General Data Protection Regulation ("GDPR") and the Liechtenstein Data Protection Act ("DSG").

Data Processing in the Context of Client Representation

 

3. Scope of Processing of Personal Data

In the context of client representation, we process the following personal data:

 

- First name and last name

- Residential address, business address

- Telephone number(s)

- Email address(es)

- Information necessary for handling the mandate depending on its nature, such as health data, marital status, asset/income data, etc.

 

We process this personal data

 

- to provide you with appropriate legal advice and representation;

- for correspondence with you;

- for invoicing;

- for the assertion or defense of claims;

- to maintain and improve the security of our IT infrastructure;

- to comply with our legal obligations and other legal requirements.

 

Data processing is generally carried out at your request and, pursuant to Art. 6 para. 1 lit. b GDPR, is necessary for the stated purposes (performance of a contract or implementation of pre-contractual measures) for the proper handling of the mandate and the mutual fulfillment of obligations arising from the mandate relationship.

 

Your data is also processed to fulfill legal obligations (Art. 6 para. 1 lit. c GDPR), in particular to comply with statutory and regulatory requirements (e.g. Lawyers Act, Due Diligence Act, tax laws).

 

Furthermore, your data is processed to safeguard legitimate interests of us or third parties (Art. 6 para. 1 lit. f GDPR) for specific purposes, in particular for asserting and enforcing claims and ensuring IT security and operations.

 

In addition, your data may be processed on the basis of your consent (Art. 6 para. 1 lit. a GDPR). You have the right to withdraw your consent at any time. This also applies to the withdrawal of consent given prior to the GDPR entering into force. However, withdrawal does not affect the lawfulness of processing carried out before the withdrawal.

 

We reserve the right to further process personal data collected for one of the above purposes for other purposes if this is compatible with the original purpose or permitted or required by law (e.g. reporting obligations).

 

We primarily collect personal data directly from you. Where necessary for the above purposes and where you have given your consent or we have a legitimate interest, we also collect your personal data from third parties authorized or obliged to disclose such data, including publicly accessible sources.

 

 

4. Disclosure of Personal Data

Your data will be disclosed to third parties:

 

- insofar as this is necessary for proper legal advice and representation (e.g. to courts/authorities and the opposing party or their representatives for the assertion/defense of claims or settlement negotiations);

- insofar as we are legally obliged to disclose it (e.g. to supervisory authorities or auditors); or

- insofar as our legitimate interests require it (e.g. to courts for the assertion of fee claims).

 

In addition, data may be transferred to processors, for example in the area of IT services, as well as to external accounting providers.

 

Data transfers to countries outside the European Economic Area (so-called third countries) only take place on the basis of adequacy decisions of the European Commission or where necessary for the performance of pre-contractual measures or a contract, where you have given your explicit consent (e.g. in the context of specific services), where required for important reasons of public interest, or where required by law.

 

 

5. Duration of Storage of Personal Data

After termination of the mandate relationship, your personal data will be stored for the duration of the general statutory retention period (currently 10 years). Longer storage may apply due to specific tax, corporate, or regulatory provisions as well as for the assertion and defense of claims.

 

 

6. Necessity of Data and Consequences of Non-Provision

The provision of your personal data is necessary for establishing and maintaining the mandate relationship. If you are not (or no longer) willing to provide us with the above-mentioned personal data, this will result in the non-establishment or termination of the mandate relationship.

 

 

Data Processing in the Context of the Website

 

7. Anonymous Data Collection

The website can generally be used without providing personal data. However, when accessing the website, information is automatically collected by the hosting provider and stored in so-called server log files. This data is stored by our hosting provider in server log files and is used exclusively for technical purposes, in particular to ensure stable and secure operation. The data collected includes, among other things:

 

- Browser type/version

- Operating system used

- Referrer URL (previously visited page)

- Hostname of the accessing computer (IP address)

- Date and time of the server request

- Name of the retrieved file

- Amount of data transferred

- Notification of successful retrieval

 

This data cannot be assigned to specific individuals by us. This data is not merged with other data sources.

 

The processing and temporary storage of this information is carried out exclusively by the hosting provider to ensure system security, for error analysis, and to defend against attacks on the server infrastructure. The data is deleted after a maximum of 12 months, unless statutory retention obligations prevent deletion.

We do not use cookies on our website.

We do not require you to provide personal information in order to download files from our website.

 

 

10. Social Plugins (LinkedIn)

Our website contains a link to the LinkedIn company profile of A AG. By clicking this link, you leave our website and are redirected directly to LinkedIn. What data LinkedIn collects about you and how it is processed can be found in LinkedIn's privacy policy (https://www.linkedin.com/legal/privacy-policy).

 

Our website does not use embedded social plugins, meaning that no information is automatically transmitted to LinkedIn or other social media providers when visiting our website.

 

 

11. Google Maps

Our contact page contains a link to Google Maps. By clicking this link, you leave our website and are redirected directly to Google Maps. In doing so, data is transmitted to Google. What data Google collects about you and how it is processed can be found in Google's privacy policy (https://policies.google.com/privacy). We have no influence over Google's data processing.

12. Your Rights

You have the right to request information about the personal data we process about you. In particular, you may request information about the purposes of processing, the categories of personal data processed, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, and the right to data portability, provided this does not involve disproportionate effort.

 

You may also request information about the origin of your data if it was not collected directly from you, as well as about the existence of automated decision-making, including profiling.

 

You also have the right to withdraw any consent given for the processing of your personal data at any time with effect for the future.

 

If you believe that the processing of your personal data violates applicable data protection laws, you have the right to lodge a complaint with the competent data protection authority.

 

 

13. Data Security

We use SSL/TLS (Secure Socket Layer / Transport Layer Security) encryption during website visits in conjunction with the highest level of encryption supported by your browser.

 

In addition, we implement appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
